Regulatory Classification of Gold Brokerage Services (BaFin Statement)
According to a written communication from the German Federal Financial Supervisory Authority (BaFin) dated of May 22, 2025, the brokerage of physical gold – such as gold bars – does not fall under financial services regulation in Germany, provided certain conditions are met.
Specifically, BaFin clarified the following:

The sale and purchase of physical gold alone, and the brokering of such transactions, do not qualify as financial instruments under the German Securities Institutions Act (WpIG) or the German Banking Act (KWG).

Gold that does not include investment characteristics, such as interest payments, repayment obligations, or any other form of asset-based compensation, is not considered a regulated investment product under German law.

As such, pure gold brokerage – where the broker simply connects buyers and sellers of physical gold and receives a success-based commission – is not subject to a financial services license requirement.
Important: This classification only applies if the broker deals exclusively with physical gold without combining it with financial instruments or investment schemes.
This regulatory clarity confirms that our gold brokerage activity is fully compliant with applicable German laws and does not require a license from BaFin under the WpIG or KWG.
